NEET-UG Mandatory for BHMS Admission: Karnataka HC

The Karnataka high court ruled that private homeopathic medical institutions cannot admit students without considering merit. NEET recommendation aims to ensure eligible students enroll in BHMS courses, which serve the best interests of the patients they care for.

Justice Alok Aradhe and Justice Vijaykumar A Patil, the HC division bench, dismissed the petition filed by the Karnataka State Private Homoeopathic Medical School Top Management Association.

The association had petitioned the High Court for a declaration that certain elements of the 2020 Conduct and the Regulations enacted under it were unconstitutional.

The HC panel dismissed the petition and highlighted that Section 14 of the 2020 Act specifies that NEET is mandatory for admission to UG coursesin Homeopathy at all medical colleges.

The bench stated, "Therefore, the legislature, in its wisdom, has adopted the opinion that merit-based admission to a common entrance test, namely NEET, can be secured."

FULL ARGUMENT

The Court clarified that the regulations published by the Central Government under the NCW Act in October 2022 and the legislation notified by the NCH in December 2022 do not apply to the admission process for theBHMS course that started in July 2022. However, the Court made it clear that the guidelines and rules will apply prospectively.

The petitioners and colleges argued that institutions providing homeopathy courses are not of all-India level and there is no excess demand over availability, which can lead to misconduct. Therefore, they claimed that there is no need for inter-se-merit assessment for competitive aspirants seeking admission through NEET 2023, as prescribed in Section 4 of the Act.

The petitioners contended that imposing the same entrance and educational criteria required for courses in allopathic medicine and dentistry on the study of homeopathy is arbitrary and unfair.

The Bench rejected the petitioners' arguments and clarified that the restriction on the petitioners' freedom to admit students into educational institutions does not violate their rights granted by the Constitution or construed in Supreme Court decisions.

The Bench nullified the State Government's notification of December 13, 2002, which applied the regulations for admissions that began in July 2022, because the NCH's regulations would only apply prospectively. The Bench permitted the petitioners to admit students for the remaining vacant seats on the basis of educational eligibility only for the academic session of 2022-23, which was recognized before the regulations were notified.

ABOUT BHMS

BHMS is Bachelor of Homeopathic Medicine and Surgery. It is an undergraduate degree program in homeopathic medicine. The duration of the BHMS course is 5.5 years, which includes 4.5 years of academic study and 1 year of compulsory internship.

During the BHMS course, students learn about the principles and philosophy of homeopathy, human anatomy, physiology, pathology, pharmacology, and homeopathic materia medica. They also gain practical knowledge through clinical training and internships.

After completing BHMS, graduates can work as homeopathic doctors in private practice or government hospitals. They can also pursue higher studies in homeopathy or allied fields such as public health, healthcare management, or clinical research.
