This is a Constitution question. The answer starts with the heading "Protection against ex-post facto laws" and then names the article.
Answer: Article 20(1) of the Constitution of India gives protection against ex-post facto laws. It means a person cannot be punished for an act that was not an offence when it was committed. A person also cannot be given a greater punishment than the one prescribed when the act was committed.
In the present case, reopening Sanjay's case and giving him imprisonment under a law violates his fundamental right under Article 20(1).
This is an administrative law question. Here the heading is "Exception of Natural Justice", and the answer explains the general rule before the exception.
Answer: Generally, the principles of natural justice apply to decisions that adversely affect a person's rights. This includes audi alteram partem, which means giving the affected person the right to be heard. However, there are some exceptions, and one of them is academic evaluation.
If a competent academic authority assesses a student's performance and finds it unsatisfactory, a pre-decision hearing is not necessary.
In this case, Ravi's performance was regularly assessed over time. It was found satisfactory. Therefore, Ravi was entitled to a pre-decisional hearing, and the natural justice principle relating to a hearing does not apply here.
This is an arbitration question about Arjun and Reyash. The heading is "Power of court to refer the matter to arbitration."
Answer: According to Section 8 of the Arbitration and Conciliation Act, 1996, a case may be brought before a court on a matter already covered by an arbitration agreement. The court shall then refer the parties to arbitration if:
There is a valid arbitration agreement, and
The application is made not later than the submission of the first statement.
The application should come with the original arbitration agreement. If the original is with the other party, the applicant files a copy and requests the court to direct the other party to produce the original.
In the present case, Reyash applied before submitting the first statement, along with a photocopy of the agreement. Therefore, the judicial authority may refer the matter to arbitration.
