Just as the Constitution of India doesn't explicitly mention the appointment of the Prime Minister, it also lacks specific details on the appointment of the Chief Minister of Maharashtra. According to Article 164, the Governor appoints the Chief Minister but with certain provisions:
  1. If a party secures a clear majority in the assembly elections, its leader may be appointed as Chief Minister.
  2. In case of no clear majority, the governor can exercise discretion to appoint a chief minister.
  3. If no party secures a clear majority, the largest party or the coalition with the most members is appointed, with a mandate to prove majority within a month.
  4. In the event of the incumbent Chief Minister's sudden demise, the Governor may appoint a successor, usually recommended by the ruling party. The Chief Minister's term is typically 5 years, subject to no term limits. He may be dismissed by a motion of no confidence by the State Legislative Assembly. Constitutional provisions related to the Chief Minister are outlined in Articles 163, 164, and 167.

Yashwantrao Chavan, a leader of the Indian National Congress, served as the first Chief Minister of Maharashtra.
