Nari Adalat Program

The Nari Adalat Program is a significant initiative launched in 2023 to empower women by providing an alternative dispute resolution mechanism at the grassroots level. This program seeks to address minor issues faced by women within their communities. Recently government has invited proposals from states to set up more Nari Adalats.

What is Nari Adalat Program?

The Nari Adalat Program, translating to "Women's Court," is an initiative under the "Sambal" sub-scheme of Mission Shakti, launched by the Ministry of Women and Child Development. It aims to provide women with an alternative grievance redressal mechanism at the Gram Panchayat level.

These women-only courts focus on resolving petty cases such as harassment, subversion, and the curtailment of rights or entitlements through negotiation, mediation, and reconciliation with mutual consent. Currently, the Nari Adalat scheme is running in 50 gram panchayats each in J&K and Assam.

Objective of Nari Adalat Program

The primary objective of the Nari Adalat Program is to empower women by providing them with a platform to resolve disputes amicably within their communities. The establishment of Nari Adalat aims to offer:

  • Alternative Dispute Resolution: To address grievances without resorting to formal legal proceedings.

  • Awareness and Education: Raise awareness about legal rights and government schemes among women.

  • Community Engagement: Encourage community participation in addressing women's issues to create a supportive environment for women's empowerment.

  • Reduction of Legal Burden: Alleviate the burden on formal judicial systems by resolving minor disputes at the community level.

Structure of Nari Adalat

Each Nari Adalat is composed of 7 to 11 members, known as Nyaya Sakhis (legal friends). The composition is as follows:

  • Elected Members: Approximately half of the Nyaya Sakhis are elected members of the Gram Panchayat.

  • Nominated Members: The remaining members are women with social standing, such as teachers, doctors, and social workers, nominated by the villagers.

The head of the Nari Adalat called the Mukhya Nyaya Sakhi, is chosen from among the Nyaya Sakhis for a typical six-month term

Implementation of Nari Adalat

The Nari Adalat Program is being implemented in phases as part of Mission Shakti. It was initially launched in the states of Assam and Jammu & Kashmir. The Nari Adalat scheme is being implemented in collaboration with:

  1. Ministry of Panchayati Raj

  2. Ministry of Rural Development

  3. Common Service Centers (CSCs) of the Ministry of Electronics and Information Technology.

Currently, the program is active in 50 gram panchayats in each state, where it began as a pilot initiative in 2023. During the 2023-24 period, over ₹20 lakh each was allocated in both states to support the program's implementation.

Nari Adalat Vs Regular Courts

While regular courts follow formal legal procedures and can be time-consuming and intimidating for many women, Nari Adalats offers an informal, community-based platform for dispute resolution. Key differences include:

  • Accessibility: Nari Adalats are located within the community, making them more accessible to women in rural areas.

  • Cost-Effectiveness: The informal nature of Nari Adalats eliminates legal fees, making justice more affordable.

  • Timely Resolution: Disputes are resolved more quickly compared to the often lengthy processes in regular courts.

  • Cultural Sensitivity: Since Nari Adalats are community-based, they better understand local customs and norms, providing solutions that fit the culture.

However, it's important to note that Nari Adalats does not have legal standing and focuses primarily on reconciliation and mediation.

Mission Shakti is an integrated women empowerment program launched by the Government of India. It is designed to address the safety, security, and empowerment of women through various initiatives. The program comprises two sub-schemes, namely:
