What is the meaning of ACJM?

Additional Chief Judicial Magistrate is the official name for the position. A civilian official who enforces the law is usually referred to as a magistrate in several legal and political systems. 

A magistrate was one of the highest-ranking government officials in ancient Rome and was also given both judicial and administrative authority.

A magistrate was in charge of running a certain region of the government in other regions of the world, including China. 

They mainly handle minor or preliminary issues. Judges may serve as untrained volunteers in some nations (like England and Wales) who carry out judicial functions.

Warren Hastings: Founding Magistrate Office 

Warren Hastings created the office of District Magistrate in 1772. Inspection of the general government, repaying land income, and upholding peace and order in the district are among the principal duties of the District Magistrate. At the time, he served as the tax organization's director. 

In addition, he was in charge of managing mortgages, allocating farmer loans, resolving disputes, and registering land. Many of the other officers in the district were under him and gave him updates on the activity of their own offices. They were also given responsibility for the District Magistrate's job. He inspects the district's police and subordinate courts as a District Magistrate.

A magistrate is a civil servant who controls the administration of justice in a given area, such as a city or district. The term "magistrate" is usually derived from the word "magistrate," which  word that denotes "a magistrate, public machinery" and "civil agents responsible for implementing laws."

He is the one who hears both criminal and civil matters before rendering a judgment. The District Magistrate or District Collector is without a doubt the Chief Executive, Administrative, and Revenue Officer. He ensures that the district's numerous governmental entities are also coordinated as needed.

Chief Judicial Magistrate

According to section 12(1) of the Criminal Procedure Code, the High Court shall appoint a judicial magistrate of the first class to the position of Chief Judicial Magistrate in each district. The CJM of the High Court appoints the CJM, one of the officers selected from the cadre of first-class judicial magistrates. There must be one CJM in each session division.

The session judge and additional session judge are superior to the CJM. The distribution of work among different courts of judicial magistrates is one of the responsibilities of the CJM.

The additional chief judicial magistrate is also referred to as an ilaka magistrate in section 14(1) of the CRPC. The places where a magistrate appointed per Section 11 or Section 13 is deemed to have been established by CJM are always determined by local boundaries. The CJM specified the first and second-class judicial magistrates' service areas.

Role of a Magistrate

  • A magistrate is a person who renders judgments on small or insignificant issues. 
  • The Magistrate provides the initial judgments in criminal cases
  • The judge, on the other hand, makes decisions in complex and challenging cases where having legal knowledge and the ability to make decisions are crucial.
  •  A magistrate can only do so little about a judge. 
  • The Governor appoints the District Magistrate, while the High Court appoints the Judicial Magistrate and Chief Judicial Magistrate.
  • Contrarily, the Chief Justice of India and the State's Governor are also consulted when the President nominates High Court judges. 
  • The President also appoints judges to the Supreme Court.
