SDM stands for Sub Divisional Magistrate. The Sub-Divisional Magistrate is an administrative post at the district level office responsible for the district subdivision. The sub-divisional magistrate in several districts is given a different title, such as deputy collector or assistant commissioner.

What is SDM?

SDM is an abbreviation for Sub Divisional Magistrate. Districts are divided to form subdivisions. Based on a country's government system, the subdivision is managed by the SDM, an administrative person frequently below the district level. 

An SDM holds the powers of collector and Executive Magistrate. An SDM may be a senior officer of the State Civil Services with suitable subordinate job experience or a junior member of the Indian Administrative Service.

SDM performs several magisterial functions under the 1973 Criminal Procedure Code, as well as a variety of minor proceedings. Typically, it is a PCS Ranking Officer. 

The Sub Divisional Magistrate is approved by the Collector Magistrate and the Tax Inspector, and all tehsils or subdivisions will be under the supervision of the Sub Divisional Magistrate. 

SDM has entire authority over his subdivision's Tahsildars and serves as a liaison between his subdivision's District Officer and Tahsildars.

The SDM has particular definitions under the various legislative acts and positions in India's legal and administrative system.

  • Sections 109,107/151,133,145,110, and 146 Cr. P.C.: The sub-divisional magistrate has various administrative benefits and powers in this portion of the administrative system.
  • Provision 20(4) Cr.P.C.: Under this section of the legislative system, the sub-divisional magistrate is positioned as the executive magistrate as the representative of the state government retaining entire command of the subdivision of the appropriate district.

Functions of SDM

The sub-divisional magistrate's role varies depending on the degree of service. The varying function of the sub-divisional magistrate in distinct working departments is described below. Let us have a look. 

Revenue Generating Records

During natural disasters like floods, earthquakes, riots, or fires, the sub-divisional magistrate is in charge of presenting detailed reports to the government.

Maintaining land records, resolving tax matters, delineation and modifications, settlement procedures, and acting as custodian of public land are all part of revenue tasks. 

Assistant Collectors and Revenue Assistants report to SDMs or Sub Divisional Magistrates. They are largely responsible for revenue collection on a daily basis. 

The primary revenue tasks of the sub-divisional magistrate are as follows:

  • Conducting revenue differentiation and modification
  • Attending to revenue cases
  • Land record keeping and management
  • The primary steward of public lands
  • Working as a lousy settlement agent

Functions in the magisterial department

Sub Divisional Magistrates have authority over Executive Magistrates. In this job, they are in charge of enforcing preventative provisions of the Code of Criminal Procedure.  

They also look into cases of unnatural deaths of women within seven years of marriage and, if required, give instructions to the police to register the case. SDMs, or Sub Divisional Magistrates, have the jurisdiction to hold inquests into fatalities in custody, such as those in police cells or prisons.  

The sub-divisional magistrate is responsible for carrying out preventions under the criminal acts code in the magisterial department. 

It is the primary function in which they exercise their authority over the executive magistrate. A sub-divisional magistrate in the magisterial department can conduct an effective investigation into the unnatural deaths of women before the police record and aid in the police investigation into fatalities in police lock-ups and prisons. 

Disaster Management 

In the case of a natural or man-made disaster, this agency is in charge of all relief and rehabilitation activities. It is also in charge of planning and implementing disaster management plans for natural and chemical catastrophes, and it is carrying out a disaster preparation awareness generation campaign with the aid of the United Nations Development Program.

The primary job of an IAS officer as a sub-divisional magistrate gives them a fundamental understanding of the administrative system from the ground level of operation, administration, and duties. 

The SDM's duties and power place him in charge of the district's welfare and development agenda. The SDM's primary function is to help the district magistrate with clerical duties as well as other operational management and control. He gains the authority to issue orders for arrest, investigation, tear gas, and curfew in the district, depending on the scenario.
