BCI Stipend Rules: Junior advocates often face money problems when they start their legal careers. Many work in senior advocates' chambers but may not get a regular stipend. This can make it hard for them to manage daily expenses and travel costs. The Bar Council of India (BCI) issued guidelines in 2024 to recommend monthly stipends for junior advocates.
The Madhya Pradesh High Court has now taken steps to make such stipend rules more effective and enforceable. Such rules can help junior advocates get the stipend and meet the expenses accordingly.
It can help them work on new research and preparation for court work. It is only possible with the regular income of the junior advocates.
Many law graduates choose litigation after completing their studies. In the early years, they may work with senior advocates and help with legal research, drafting, case preparation and court work.
However, some junior advocates do not receive proper payment for this work. Without a regular income, it can be difficult for them to pay for food, travel and other basic needs. This may also make it difficult for young lawyers without an independent client base to continue in litigation.
The issue of junior advocate stipends came before the Madhya Pradesh High Court during the case of Vipin Pandey v. Rani Durgavati University, Jabalpur and Others.
During the hearing, a junior counsel appeared before the Court and asked for an adjournment because the senior advocate was not present. When the Court asked about the working conditions and payment received by the junior advocate, it was informed that no stipend or payment was being given by the senior's chamber.
The Court took note of the financial difficulties faced by junior advocates and issued directions to improve the system of payment.

BCI's 2024 circular recommended monthly stipends for junior advocates during their first three years of practice. These amounts were recommendations and were not automatically enforceable.
