Illegal MBBS Admissions: After the National Medical Commission (NMC) ruled that the admission of 150 MBBS students at GR Medical College, Mangaluru was "illegal and arbitrary," the institute's medicos have petitioned the Karnataka High Court for permission to take the examination.

The petition, which was filed by 99 institution students, also requested that these students be transferred to any government medical college so that they could finish their education.

Illegal MBBS Admissions, NMC's Ruling and Medicos' Petition

The Karnataka High Court bench of Justice G Narendar and Justice Vijayakumar A Patil granted the petition and sent notice to the State Government, the Union Government, and Rajiv Gandhi University of Health Sciences. The National Medical Commission (NMC), Medical Assessment and Rating Board (MARB), Karnataka Examinations Authority (KEA), and GR Medical College have also been served a notice. The case has been rescheduled for a hearing on September 20, 2023.

Illegal MBBS Admissions, Background on NMC's Findings

The petition was brought before the HC bench after the Apex Medical Education Regulatory Body, NMC, deemed the admission of 150 MBBS students from the 2022-2023 batch to the GR Medical College, Mangaluru, to be "illegal and arbitrary." Medical Dialogues previously stated that, in a letter to the Health and Family Welfare Department, the Medical Assessment and Rating Board (MARB) of NMC notified the department that the institution had been granted permission to open in 2021-2022 with an annual intake of 150 MBBS seats. However, the Commission reportedly rejected the idea for a second batch during the school year 2022-2023. According to the NMC notification, the disapproval was made based on MARB's assessment of the college on September 5 and 6, 2022. Despite the NMC's opposition, the college purportedly admitted pupils.

Illegal MBBS Admissions, Medicos' Appeal for Examination and Transfer

In the letter, NMC stated, "However, the college illegally and arbitrarily admitted 150 MBBS students for 2022-23 without valid permission." According to a recent Deccan Herald media article, a total of 99 students have now petitioned the Karnataka High Court. They have requested that registration numbers be issued in order for them to appear in the examination slated to begin on October 31, 2023. They have also requested transfer to any government medical college in order to continue their education. According to the petitioner students, they were assigned seats in the second mop-up round for the academic year 2022-2023, and because GR Medical College was listed in the seat matrix, they assumed the college possessed all of the necessary NMC approvals.

Illegal MBBS Admissions, Uninformed Admission, and NMC's Assessment

The petitioners claimed that it was only after their admission that they learned about Apex Medical Body's refusal to admit 150 students. This was based on the Medical Assessment and Rating Board's (MARB) recommendation. Furthermore, the petitioners alleged that they were not informed of the suspension of admission for the school year 2022-2023. "Since the NMC inspection report has revealed that the GR Medical College does not have the requisite faculty, clinical material, and infrastructure mandated by the NMC, the said medical college is not legally entitled to impart medical education," the plea read. As a result, the petitioners must be sent to colleges where they can receive the necessary education. The petitioners also stated that the Karnataka Examinations Authority (KEA), a State Government institution, had admitted them to the relevant medical college. In response, they claimed that it is only the State Government's responsibility to transfer them to a government medical college to continue their medical study. In light of the impending closure of GR Medical College as a result of the decision to halt admission for the academic year 2023-2024, the petitioners asked the Court to intervene in the matter and provide appropriate directions to the State Government to preserve their interests.
